Objective
These Terms and Conditions regulate the use of tourist services offered by Machupicchu By World, with RUC 20609245558, hereinafter ‘The Agency’, to clients contracting tourist packages, tickets, accommodations, tours, excursions, and other related services.
Reservations and Payments
- All reservations are confirmed with a minimum deposit of 50% of the total service value.
- The remaining balance must be paid by the day of arrival.
- Prices are subject to change without prior notice until payment is confirmed.
Cancellations and Refunds
- Cancellations made more than 30 days in advance: a penalty for administrative costs, train tickets, Machu Picchu entrance tickets, and hotel will be charged.
- Cancellations made less than 30 days in advance: no refund.
- Some services (air tickets, trains, Machu Picchu tickets, etc.) are non-refundable according to provider policies.
Responsibility
- The Agency acts as an intermediary between the client and providers (airlines, hotels, transport, tour operators).
- Not responsible for delays, itinerary changes, losses, accidents, or force majeure (weather, strikes, natural disasters, etc.).
- The client is responsible for valid travel documents (ID, passport, visas, vaccines if required).
Itinerary Modifications
The Agency may modify itineraries or services for safety reasons, weather conditions, or other causes beyond its control, guaranteeing alternatives of equal or greater value.
Insurance
Clients are recommended to purchase travel insurance covering accidents, illnesses, cancellations, or lost luggage.
Data Protection
The Agency protects clients’ personal data in accordance with Law N° 29733 – Personal Data Protection Law.
Applicable Law
These Terms and Conditions are governed by Peruvian law, particularly Indecopi regulations and the General Tourism Law.
No Show
If the client does not show up for the tour, no refund will be made, considered a no show. Clients are responsible for carrying valid personal documentation, migration cards, and passports. They must protect personal belongings during international and national transport. Luggage must have documentation from the service provider to claim loss or damage. Clients are advised to have travel insurance before leaving their country. Responsible and sustainable tourism practices must be followed to protect cultural and natural attractions.
Company Responsibilities
MachuPicchu by World is obligated to provide 100% of the contracted services. In unforeseen cases where services are not provided and the responsibility is attributable to the company, the client can demand a full refund for unprovided services. The agency will provide alternatives and assist in repairing any damages. Force majeure events (social issues, government actions, weather, disasters, epidemics, pandemics) are not attributable to the agency.
Digital Voucher
By paying for the reservation, the client accepts these Terms and Conditions, giving free and express consent for the processing of personal data, which will be used solely to update our database and provide the contracted services. Clients acknowledge the risks of tourism activities.
Client Rights
- Access clear and truthful information about the contracted services.
- Receive a payment receipt (invoice or voucher).
- Submit claims to the Agency or through the physical or virtual Complaints Book.
Rates and Itinerary
- Program rates are subject to changes according to currency trends in the market. Prices do not include legal taxes for national tourists. For foreign tourists, Law N° 919 applies.
- Scheduled activities in itineraries may change due to external factors beyond the company’s control. Actions will be taken to prioritize tourist safety in cases such as social issues, government actions, weather conditions, natural disasters, epidemics, pandemics, or any other factor preventing free activity development. The travel agency is not responsible for such events, additional expenses, or non-provision of services caused by these factors.
Property Rights
- All site content, features, and functionality, including text, graphics, logos, icons, and images, are the exclusive property of Machupicchu By World or its content providers and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
- These Terms allow the Explorer to use the Site solely for personal and non-commercial purposes. The Explorer must not reproduce, distribute, modify, create derivative works, publicly display, publicly perform, republish, download, store, or transmit any Site material, except:
- Temporary copies may be stored in RAM during access and viewing.
- Browser cache may store files automatically to improve viewing.
